Because Texas has carry without a permit, anyone 21 years of age or older who can legally possess a firearm under Texas federal and state law can carry a concealed firearm on their person without a license or permit. Texans can carry guns without a license or training starting in September. Greg Abbott signed the permit free transportation bill Wednesday. The new law will take effect in September.

Texas law does not place specific restrictions on who can carry a long gun, such as a rifle or shotgun. Proponents of what Republicans call “constitutional carry” argued that Texas should follow the example of at least 20 other states with similar laws on the books. For Charles Cotton, first vice president of the National Rifle Association, who lobbied for it to be loaded without a permit in Texas and other states, those fears are exaggerated. Now, people who qualify under the law can carry a gun in a public place in Texas without a license to carry (LTC).

Section 46.02 of the Texas Penal Code requires that a gun be carried in a holster, but does not provide a definition of the word holster. That includes college campuses and government meetings, according to the Texas Department of Public Safety, along with any private company that decides to ban the carrying of weapons without a license, and has room for more no-gun signs. Texas law gives most private owners the power to choose whether they want to allow guns on their property or not. Conservative activists have long lobbied for a permitless transportation law in Texas, but such measures had little force in the previous three legislative sessions.

Texas law enforcement officials expressed strong opposition to the new law as it progressed through the Legislature. House Bill 1927 removes the requirement for Texas residents to obtain a handgun license if state or federal law does not prohibit them from possessing a gun. Nearly six out of 10 Texas voters surveyed by the University of Texas and the Texas Tribune in April opposed permissionless hauling.

Before the Permissionless Carrying Act was signed, Texans generally needed a license to carry firearms openly or concealed. Dan Patrick and other Republicans who initially failed to commit to the bill came under immense political pressure this session from conservatives and gun rights advocates, who have long lobbied the Texas Legislature to take them without permission. But some Texas law enforcement officials fear that removing restrictions on carrying guns could increase crime rates and endanger officers and residents. Among other Senate changes that were incorporated into the law, was the requirement that the Texas Department of Public Safety offer a free online course on firearm safety.
